Grounds for Divorce: The court may grant a no fault divorce upon a showing of Incompatibility. The court may grant a fault divorce upon a showing of any of these grounds: 
1. Cruel and inhuman treatment
2. Adultery
3. Abandonment

Residency Requirements: In order to file for divorce in New Mexico, either party must have resided in the state for at least six months immediately preceding the date of the filing and has a domicile in New Mexico. [New Mexico Revised Statutes]
