Grounds for Divorce: The court may grant a no-fault divorce upon a finding that irreconcilable differences between the parties have caused the irremediable breakdown of the marriage. The court may grant a fault divorce upon a finding that (1) "either party to the marriage was incapable of making such contract or consenting thereto for want of legal age or sufficient understanding, or (2) the consent of either party was obtained by force or fraud; provided that in the situations described in subsection (1) or (2), the contract was not afterward ratified." [Oregon Revised Statutes]
Residency Requirements: The marriage took place in Oregon and either party is a resident of or domiciled in the state at the time the divorce is filed, or if the marriage did not take place in Oregon or when any ground other than a fault ground is alleged, at least one party must be a resident of or be domiciled in Oregon at the time the divorce is filed and continuously for a period of six months prior thereto.
